ADVERTISER AGREEMENT

2. ADVERTISING PACKAGE

3. ADVERTISING AGREEMENT

By signing this Agreement, the Advertiser agrees to purchase the selected BerkoRadio advertising package at the price shown above.

BerkoRadio agrees to provide the advertising services included within the selected package for the agreed campaign period.

Advertising schedules may vary from day to day. BerkoRadio will make reasonable efforts to deliver the agreed number of advertising plays over the campaign period.

4. ADVERT PRODUCTION

Where advert production is included, BerkoRadio will produce a suitable radio commercial using information supplied by the Advertiser.

The Advertiser will normally be given the opportunity to approve the final advert before it is broadcast.

The Advertiser is responsible for ensuring that all business information, prices, offers, contact details and claims supplied to BerkoRadio are accurate.

BerkoRadio reserves the right to refuse or amend advertising material that it considers unsuitable, misleading, unlawful or incompatible with applicable broadcasting or advertising requirements.

5. PAYMENT

Advertising packages are charged monthly.

Unless otherwise agreed in writing, payment is required in advance of each advertising month.

Payment can be made by bank transfer or another payment method accepted by BerkoRadio.

If payment is not received when due, BerkoRadio may suspend the advertising campaign until payment is received.

All prices are exclusive of VAT where VAT is applicable.

6. MINIMUM CAMPAIGN PERIOD

The standard advertising package is offered on a monthly rolling basis.

The Advertiser may cancel by giving 30 days' written notice.

Any advertising already delivered during the notice period remains payable.

Longer-term advertising agreements may be offered at separately agreed rates.

7. CANCELLATION

Cancellation must be made in writing by email.

If an Advertiser cancels before a campaign has started, BerkoRadio may retain or charge reasonable costs already incurred, including advertising production costs.

Once a monthly campaign has commenced, the monthly fee remains payable for that month.

8. MISSED ADVERTISING

BerkoRadio will make reasonable efforts to broadcast advertisements in accordance with the agreed package.

If an advert is missed because of a BerkoRadio scheduling or technical error, BerkoRadio may provide a replacement broadcast.

BerkoRadio will not be liable for interruptions caused by circumstances outside its reasonable control, including internet outages, hosting failures, power failures or third-party technical problems.

9. ADVERTISER RESPONSIBILITY

The Advertiser confirms that:

• Information supplied to BerkoRadio is accurate.

• It has the necessary rights to use any logos, photographs, music or other material supplied.

• Its advertising complies with applicable UK laws and advertising requirements.

• Any claims made about its products or services can be substantiated where required.

The Advertiser agrees to cooperate with BerkoRadio where evidence or clarification is reasonably required.

10. BERKORADIO'S RIGHT TO REFUSE ADVERTISING

BerkoRadio reserves the right to refuse, suspend or withdraw an advertisement where it reasonably believes that the advertisement:

• Breaks the law or applicable advertising rules.

• Is misleading or cannot be substantiated.

• Is offensive or inappropriate.

• Could expose BerkoRadio to legal or regulatory action.

• Is unsuitable for the BerkoRadio audience.

Where reasonably possible, BerkoRadio will discuss the issue with the Advertiser and allow an amended advertisement to be supplied.

11. WEBSITE & SOCIAL MEDIA

Where included in the selected package, BerkoRadio may display the Advertiser's business name, logo, contact information, website and promotional material on its website and/or social media channels.

BerkoRadio reserves the right to remove outdated or inappropriate promotional material.

12. SPONSORED FEATURES & INTERVIEWS

Gold package customers may receive a sponsored feature or interview.

The content, duration and broadcast date will be agreed between BerkoRadio and the Advertiser.

Sponsored content will be identified appropriately where required by applicable rules.

13. INTELLECTUAL PROPERTY

The Advertiser retains ownership of its trademarks, logos, photographs and other material supplied to BerkoRadio.

The Advertiser grants BerkoRadio permission to use those materials for the purpose of providing the agreed advertising services.

Unless otherwise agreed, original advertising production created by BerkoRadio remains the property of BerkoRadio.

14. LIABILITY

BerkoRadio will provide its services with reasonable care and skill.

BerkoRadio will not be responsible for indirect losses, loss of profits or loss of business arising from an advertising campaign.

Nothing in this Agreement excludes or limits liability where doing so would be unlawful.

15. REGULATORY COMPLIANCE

Advertising broadcast by BerkoRadio must comply with applicable UK broadcasting and advertising requirements.

BerkoRadio may require changes to advertisements where necessary to comply with those requirements.

The Advertiser agrees to provide information or evidence reasonably required to support advertising claims.

16. DATA PROTECTION

BerkoRadio will handle Advertiser information in accordance with applicable UK data protection law.

Advertiser information may be used to:

• Process advertising bookings.

• Issue invoices.

• Manage advertising campaigns.

• Contact the Advertiser regarding its campaign.

• Provide the agreed advertising services.

BerkoRadio will not sell Advertiser contact information to third parties.

17. CHANGES TO PACKAGES

BerkoRadio may change its advertising packages and prices for future bookings.

Existing campaigns will normally continue at the agreed price until the end of the current agreed period unless otherwise agreed.

18. GOVERNING LAW

This Agreement is governed by the laws of England and Wales.

Any dispute will initially be addressed through good-faith discussions between the Advertiser and BerkoRadio.

19. AGREEMENT

By signing below, the Advertiser confirms that it has read, understood and agrees to this Advertiser Agreement and the BerkoRadio Advertising Terms & Conditions.
